NOTICE IS HEREBY GIVEN that the undersigned, the Clerk of the Circuit Court for Collier County, Florida, under and pursuant to the Final Summary Judgment in Favor of BB&T heretofore entered on the 11th day of March, 2013, in that certain cause pending in the Circuit Court of the Twentieth Judicial Circuit, in and for Collier County, Florida, being Civil Action No. 2012-03749-CA, in which BRANCH BANKING AND TRUST COMPANY, successor in interest to Colonial Bank by acquisition of assets from the FDIC as Receiver for Colonial Bank, f/k/a Colonial Bank, N.A., as assignee to IronStone Bank, a federal savings bank (“BB&T”) is the Plaintiff and AUDUBON HOLDINGS, LLC, a Florida limited liability company (“Audubon Holdings”); J.R. BRADY ACQUISITION COMPANY, INC., a Florida corporation (“J.R. Brady Acquisition”) and JOHN R. BRADY, individually (“Brady”), jointly and severally, are the Defendants, and under and pursuant to the terms of said Final Judgment will offer for sale at public outcry to the highest and best bidder for cash, on the Third Floor, Lobby, of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, Florida 34112 on June 10, 2013 at 11:00 a.m. in accordance with Chapter 45 Florida Statutes, the same being a legal sales day and the hour a legal hour of sale, the real and personal property situated in Collier County, Florida and legally described as follows:
Real Property
A parcel of land located in Tract “Z”, AUDUBON COMMERCIAL CENTER, as recorded in Plat Book 34, Pages 16 through 17, of the Public Records of Collier County, Florida, more particularly described as follows: Beginning at the Northeast corner of said Tract “Z”, proceed South 02'09'35” East for 183.13 feet along the East line of said Tract “Z”; thence leaving said East line South 87°50'25” West for 135.00 feet; thence North 02'09'35” West for 183.13 feet to a point on the North line of said Tract “Z”; thence along said North line North 87'50'25” East for 135.00 feet to the Point of Beginning of the parcel herein described

together with all improvements, fixtures, tenements, hereditaments and appurtenances pertaining thereto.
The property aforesaid, together with all improvements, buildings, fixtures, tenements, hereditaments and appurtenances thereto belonging, or in anywise pertaining, is being sold to satisfy BB&T's claims under said Judgment.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
