NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment of Foreclosure dated October 14, 2013, and entered in Case No. 2009-CA-011750 of the Circuit Court of the TWELFTH Judicial Circuit in and for Sarasota County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS SUCCESSOR TRUSTEE TO JPMORGAN CHASE BANK, N.A. AS TRUSTEE FOR THE BEAR STEARNS ALT-A TRUST, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2004-9 is the Plaintiff and MARY PENDARVIS A/K/A MARY E. PENDARVIS A/K/A MARY ELIZABETH DEAR, et al., the Defendants, I will sell to the highest and best bidder for cash online at www.sarasota.realforeclose.com, the Clerk's website for on-line auctions, at 09:00 a.m. on November 18, 2013, the following described property as set forth in said Order of Final Judgment, to wit:
Lot 4, Block A, Country Club Shores. Unit 3, Section 1, As Per Plat Thereof Recorded In Plat Book 17, Page 9, Of The Public Records Of Sarasota County, Florida.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK OF COURT NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
