NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 4th day of September 2013, and entered in Case No. 52-2010-CA-013713, of the Circuit Court of the 6TH Judicial Circuit in and for Pinellas County, Florida, wherein THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK, AS TRUSTEE FOR THE HOLDERS OF THE CERTIFICATES, FIRST HORIZON MORTGAGE PASS-THROUGH CERTIFICATES SERIES FHAMS 2005-AA5, BY FIRST HORIZON HOME LOANS, A DIVISION OF FIRST TENNESSEE BANK NATIONAL ASSOCIATION, MASTER SERVICER, IN ITS CAPACITY AS AGENT FOR THE TRUSTEE UNDER THE POOLING AND SERVICING AGREEMENT is the Plaintiff and ROBERT G. TENEYCK A/K/A ROBERT G. TEN EYCK, BELLEAIR OAKS CONDOMINIUM ASSOCIATION, INC., COMMERCIAL FIRE AND COMMUNICATIONS, INC., JENNIFER BECKON TENEYCK A/K/A JENNIFER BECKON TEN EYCK and UNKNOWN TENANT(S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 5th day of December, 2013, at 10:00 AM on Pinellas County's Public Auction website: www.pinellas.realforeclose.com in accordance with chapter 45, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM PARCEL; UNIT NO. 509, OF BELLEAIR OAKS, A CONDOMINIUM, ACCORDING TO THE PLAT THEREOF RECORDED IN CONDOMINIUM PLAT BOOK 41, PAGE(S) 8 - 10, AND BEING FURTHER DESCRIBED IN THAT CERTAIN DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS BOOK 5009, PAGE 3 THROUGH 46, ET SEQ,. TOGETHER WITH SUCH ADDITIONS AND AMENDMENTS TO SAID DECLARATION AND CONDOMINIUM PLAT AS FROM TIME TO TIME MAY BE MADE AND TOGETHER WITH AN UNDIVIDED INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO. ALL AS RECORDED IN THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
