NOTICE OF SALE IS HEREBY GIVEN pursuant to an Order of Final Judgment of Foreclosure filed November 20, 2013 and entered in Case No. 12-CA-003453 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida. Plaintiff Sunset Pointe at Fort Myers Condominium Association, Inc. is Plaintiff and Della Upshaw and United Stated of American for the Internal Revenue Service are the Defendants, I will sell to the highest and best bidder for cash on www.lee.realforeclose.com at 9:00 A.M. on the 20 day of December, 2013, the following described property as set forth in said Order or final Judgment to wit:
Unit D, Building 12620 in Sunset Pointe at Fort Myers Condominium, a Condominium According to the Declaration of Condominium recorded under Clerk's file number 20050001310418 and amendments thereto, of the Public Records of Lee County, Florida; together with an undivided interest in the common elements appurtenant thereto.

Any person claiming an interest in the surplus from the sale, if any, other than the property owner and the United States of America as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale. The United States of America as a lienholder shall have the right to exercise its right of redemption pursuant to Title 28, U.S.C. Section 2410 (c) within 120 days from the date of the sale. The United States shall not be bound by the sixty day time period imposed by Fla. Statute 45.032 upon motions for distribution of surplus proceeds.
