The Petition for the Ancillary Probate of Will and Appointment of Personal Representative, signed by Cheri Marie Gnerer Johnson was filed with the Collier County Probate Court.
The Court, having read and considered the Petition, determines the following:
1. The Court has jurisdiction and venue in this County is proper.
2. The Petition is complete.
3. The Petitioner has declared and affirms that the representations contained in the Petition are true and complete to the best of the Petitioner's knowledge or belief.
4. The Petitioner is an interested person as defined by Florida law.
5. Any notice required by Florida law will be given.
6. Decedent died on March 1, 2012.
7. Decedent' Will is comprised of a Last Will and Testament dated August 18,1997 and said Will was admitted to a Formal Probate in Hennepin County, Minnesota, and the Order of Formal Probate of Will and Formal Appointment of Personal Representative was issued on July 27, 2012.
8. The documents comprising the Will have been probated in Hennepin County, Minnesota and an authenticated copy of the Will and Order probating the same accompany this Petition.
9. The Petition indicates that there is no personal representative appointed in this or other county of Florida whose appointed has not been terminated.
10. The person appointed below has priority and is entitled to be appointed personal representative and is not disqualified to serve as personal representative.
11. Decedents' heirs under Florida law are as identified in the Petition commencing this proceeding.
12. Decedent did not leave a surviving spouse.
13. No objections to the Petition has been asserted.
IT IS ORDERED:
1. The Petition is granted.
2. The Will is admitted for ancillary probate.
3. Cheri Marie Gnerer Johnson is formally appointed the Personal Representative of the Decedent's estate with no bond.
4. Upon filing of statement of acceptance, letters of administration will be issued.
