NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated August 30, 2013 and entered in Case No. 36-2012-CA-050578-A-001-CH in the Circuit Court of the 20th Judicial Circuit in and for Lee County, Florida wherein DEUTSCHE BANK TRUST COMPANY AMERICAS AS TRUSTEE FOR RALI 2004QS12 was the Plaintiff and CHRISTINE KUZYK, ET AL., the Defendant(s), I will sell to the highest and best bidder for cash, by electronic sale beginning at 9:00 a.m. at www.lee.realforeclose.com, on the 2 day of October, 2013, the following described property as set forth in said Final Judgment:
A PORTION OF LOTS 3 AND 4, BLOCK B, IN THAT CERTAIN SUBDIVISION KNOWN AS RIVER'S EDGE, ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND RECORDED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF LEE COUNTY, FLORIDA, IN PLAT BOOK 8, PAGE 53, DESCRIBED AS FOLLOWS: FROM THE NORTHWEST CORNER of said lot 3 run east for 300 feet to the northeast corner OF LOT 4, THENCE RUN SOUTH, ALONG THE EAST LINE OF SAID LOT 4 FOR 30 FEET; THENCE RUN SOUTH 55 DEGREES WEST FOR 148.5 FEET TO AN INTERSECTION WITH A CURVE OF RADIUS 30 FEET TO THE CENTER OF WHICH IS LOCATED ON THE LINE BETWEEN LOTS 3 AND 4 AT A POINT 125 FEET SOUTH OF THE NORTH LINE OF SAID LOTS; THENCE RUN NORTHWESTERLY, WESTERLY AND SOUTHWESTERLY, ALONG THE ARC OF SAID CURVE FOR 74.02 FEET; THENCE RUN NORTH 55 DEGREES WEST OF 148.5 FEET TO THE WEST LINE OF SAID LOT 3 THENCE RUN NORTH ALONG SAID WEST LINE FOR 30 FEET TO THE POINT OF BEGINNING.
TOGETHER WITH AN EASEMENT FOR DRIVEWAY PURPOSES OVER AND ACROSS THE CIRCULAR COURT, AND ACROSS A STRIP OF LAND 30 FEET WIDE, BEING THE EAST 15 FEET OF SAID LOT 3 AND THE WEST 15 FEET OF SAID LOT 4, LYING BETWEEN THE ABOVE DESCRIBED PARCEL AND THE NORTHERLY LINE OF NORTH SHORE AVENUE AS SHOWN ON THE PLAT OF RIVER'S EDGE.
any person claiming an interest in the surplus of the sale, if any, other than the property owner, as of the date of the lis pendens, must file a claim within sixty (60) days after the sale.
