NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of foreclosure dated August 30, 2013 and entered in Case No. 13-CA-050443 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein SOVEREIGN BANK, N.A., is Plaintiff, and MARGUERITE V. PARKER, et al are Defendants, the clerk will sell to the highest and best bidder for cash, beginning at 9:00 am at www.lee.realforeclose.com, in accordance with Chapter 45, Florida Statutes, on the 2 day of October, 2013, the following described property as set forth in said Summary Final Judgment, to wit:
LOT 43, BLOCK 4784, CAPE CORAL, UNIT 71, ACCORDING TO THE MAP OR PLAT THEREOF AS REOCRDED IN PLAT BOOK 22, PAGES 88 THROUGH 107, INCLUSIVE, PUBLIC RECORDS OF LEE COUNTY, FLORIDA. TOGETHER WITH A PORTION OF LOT 44 OF SAID BLOCK 4784, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGIN AT A CONCRETE MONUMENT MARKING THE SOUTHEAST CORNER OF SAID LOT 44, SAID MONUMENT ALSO LIES ON THE WESTERLY RIGHT-OF-WAY LINE OF S.W. 17TH AVENUE (60 FEET WIDE); THENCE SOUTH 78 DEGREES 42 MINUTES 50 SECONDS WEST ALONG THE SOUTHERLY LINE OF SAID LOT 44 FOR 127.39 FEET TO THE SOUTHWEST CORNER OF SAID LOT 44; THENCE NORTH 34 DEGREES 54 MINUTES 25 SECONDS EAST FOR 55.14 FEET; THENCE NORTH 89 DEGREES 58 MINUTES 05 SECONDS WEST FOR 31.14 FEET; THENCE NORTH 70 DEGREES 23 MINUTES 12 SECONDS EAST FOR 66.09 FEET TO A POINT ON SAID WESTERLY RIGHT-OF-WAY LINE OF S.W. 17TH AVENUE; THENCE SOUTH 00 DEGREE 05 MINUTES 28 SECONDS EAST ALONG SAID WESTERLY RIGHT-OF-WAY LINE FOR 42.45 FEET TO THE POINT OF BEGINNING.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
