NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 11 day of September, 2013, and entered in Case No. 09006257CA, of the Circuit Court of the 20TH Judicial Circuit in and for Charlotte County, Florida, wherein BANK OF NEW YORK MELLON, FKA THE BANK OF NEW YORK, AS TRUSTEE ON BEHALF OF THE HOLDERS OF THE ALTERNATIVE LOAN TRUST 2005-59 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-59 is the Plaintiff and BARBARA L. GIFFORD, AMSOUTH BANK, and UNKNOWN TENANT(S) N/K/A STEPHEN GIFFORD are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.charlotte.realforeclose.com in accordance with Chapter 45, Florida Statutes at, 11:00 AM on the 9th day of October, 2013, the following described property as set forth in said Final Judgment, to wit:
LOT 3, BLOCK N, PEACE RIVER SHORES, UNIT 6, ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 4 AT PAGES 32A, 32B AND 32C OF THE PUBLIC RECORDS OF CHARLOTTE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
