NOTICE IS HEREBY GIVEN pursuant to a Final Judgment dated June 12, 2013, entered in Civil Case No.: 41-2012-CA-003394, DIVISION: D, of the Circuit Court of the TWELFTH Judicial Circuit in and for Manatee County, Florida, wherein BANK OF AMERICA, N.A. is Plaintiff, and CARMEN M. MARTINEZ; JULIO GERBI A/K/A JULIO A. GERBI; UNKNOWN SPOUSE OF CARMEN M. MARTINEZ; UNKNOWN SPOUSE OF JULIO GERBI A/K/A JULIO A. GERBI; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR COUNTRYWIDE HOME LOANS, INC.; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendant(s).
R.B. “Chips” Shore, the Clerk of Court Shall sell to the highest bidder for cash at 11:00 a.m., at an online public sale at www.manatee.realforeclose.com on the 15th day of October, 2013 the following described real property as set forth in said Final Judgment, to wit:
THE SOUTH 80 FEET OF THE FOLLOWING DESCRIBED PARCEL OF LAND: BEGIN AT THE NE CORNER OF PARCEL MARKED A OF BEAR PARK, A SUBDIVISION, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 8, PAGE 55, OF THE PUBLIC RECORDS OF MANATEE COUNTY, FLORIDA; THENCE RUN WEST 167 FEET FOR A POINT OF BEGINNING; THENCE RUN WEST 94.3 FEET TO THE NW CORNER OF PARCEL A; THENCE RUN SOUTH ALONG THE WEST LINE OF SAID PARCEL A, 178.51 FEET TO THE SW CORNER OF SAID PARCEL A; THENCE EAST ALONG THE SOUTH LINE OF SAID PARCEL A, 94.3 FEET TO A POINT DUE SOUTH OF THE POINT OF BEGINNING; THENCE NORTH 178.5 FEET TO THE POINT OF BEGINNING. ALL LYING AND BEING IN MANATEE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
