NOTICE IS HEREBY GIVEN pursuant to a Final Judgment dated March 26, 2014, entered in Civil Case No.: 11-2012-CA-001581, of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein ONEWEST BANK, F.S.B., is Plaintiff, and ANNELIESE SCHLUDERBERG, DECEASED; GUNTER E. L. VON DER HEYDE, AS PERSONAL REPRESENTATIVE OF THE ESTATE OF ANNELIES; DIETER VON DER HEYDE, POSSIBLE HEIR, BENEFICIARY, AND/OR DEVISEE OF THE ESTATE O; GUNTER E. L. VON DER HEYDE, POSSIBLE HEIR, BENEFICIARY, A UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendant(s).
DWIGHT E. BROCK, the Clerk of Court shall sell to the highest bidder for cash in the lobby on the Third Floor of the Collier County Courthouse Annex, located at 3315 Tamiami Trail East, Naples, FL 34112 at 11:00 a.m. on the 23 day of April, 2014 the following described real property as set forth in said Final Judgment to wit:
THAT CERTAIN CONDOMINIUM PARCEL CONSISTING OF UNIT 9-305, TOGETHER WITH AN UNDIVIDED SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH AND SUBJECT TO THE TERMS, CONDITIONS, COVENANTS, EASEMENTS, RESTRICTIONS, AND OTHER PROVISIONS OF THAT CERTAIN DECLARATION OF CONDOMINIUM OF ARBOR TRACE, A CONDOMINIUM RECORDED IN O.R. BOOK 1634, PAGE 1634 AND RE-RECORDED IN O.R. BOOK 1643, PAGE 1444, AND ANY AMENDMENTS THERETO, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
