NOTICE OF PUBLIC HEARING TO ADOPT ORDINANCE 2014-01
The Town of Windermere, Florida, proposes to adopt Ordinance 2014-03. The Town Council of Windermere, Florida, will hold a public hearing at the Town Hall located at 520 Main Street, Windermere, Florida, on Tuesday, APRIL 22, 2014, at 6:00 P.M. (or as soon thereafter as the matter may be considered) to consider passage of the proposed Ordinance 2014-03, the title of which reads as follows:
ORDINANCE NO. 2014-03
AN ORDINANCE OF THE TOWN OF WINDERMERE, FLORIDA PERTAINING TO PUBLIC HEALTH AND SAFETY; ADDING A NEW ARTICLE ENTITLED “UNSAFE STRUCTURES” TO CHAPTER 6 OF THE TOWN OF WINDERMERE'S CODE OF ORDINANCES TO PROVIDE FOR THE REPAIR, CONDEMNATION AND DEMOLITION OF UNSAFE STRUCTURES; PROVIDING DEFINITIONS; DECLARING UNSAFE STRUCTURES TO BE A NUISANCE; PROHIBITING THE MAINTENANCE OR EXISTENCE OF AN UNSAFE STRUCTURE IN THE TOWN; SETTING FORTH THE POWERS AND DUTIES OF THE TOWN'S CODE INSPECTOR; PROVIDING FOR THE ORDER OF CONDEMNATION, PLACARDING, AND THE NOTICE AND ORDER OF THE CODE INSPECTOR; PROVIDING THE METHODS OF SERVICE OF THE CONDEMNATION/DEMOLITION NOTICE AND ORDER; PROVIDING AN EXTENSION OF TIME TO COMPLY WITH THE CONDEMNATION/DEMOLITION ORDER; PROVIDING FOR THE TOWN'S ACTION WHEN AN OWNER OR INTERESTED PARTY FAILS TO COMPLY WITH THE CONDEMNATION/DEMOLITION NOTICE AND ORDER; PROVIDING FOR EMERGENCY CONDEMNATIONS; PROVIDING FOR APPEALS; REQUIRING UNSAFE STRUCTURES TO BE SECURED; PROVIDING STANDARDS FOR THE CONDITION OF A LOT AFTER DEMOLITION; AUTHORIZING THE IMPOSITION AND LEVY OF SPECIAL ASSESSMENTS IF COSTS ARE INCURRED BY THE TOWN AND NOT REIMBURSED BY THE PROPERTY OWNER AND, IF APPLICABLE, THE PROPERTY AGENT, CUSTODIAN, LESSEE, OR OCCUPANT; REQUIRING NOTICES OF ASSESSMENT; ESTABLISHING THE TOWN AS A SPECIAL ASSESSMENT DISTRICT; AUTHORIZING THE LEVY OF NON-AD VALOREM ASSESSMENTS AND PROVIDING FOR THE COLLECTION OF NON-AD VALOREM ASSESSMENTS; AUTHORIZING AN AGREEMENT WITH THE ORANGE COUNTY PROPERTY APPRAISER AND TAX COLLECTOR; AUTHORIZING AND REQUIRING THE ADOPTION OF A RESOLUTION REGARDING THE TOWN'S USE OF THE UNIFORM METHOD OF COLLECTING NON-AD VALOREM ASSESSMENTS; PROVIDING FOR ANNUAL NON-AD VALOREM ASSESSMENT ROLLS; PROVIDING TRANSITION PROVISIONS AND RATIFYING ASSESSMENTS TO RECOVER COSTS INCURRED BY THE TOWN TO REMEDY VIOLATIONS PRIOR TO THE ORDINANCE'S ENACTMENT; PROVIDING FOR SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE.
Interested parties may appear at the meeting and be heard with respect to the proposed Ordinance.
This proposed ordinance is available at the Town Clerk's Office, 614 Main Street, Windermere, Florida, for inspection during normal business hours of Mon-Fri 8:00 a.m. - 5:00 p.m.
Persons with disabilities needing assistance to participate in this proceeding should contact the Town Clerk 48 hours before the meeting.
Persons are advised that if they decide to appeal any decision made at this meeting, they will need a record of the proceeding, and for such purposes, they may need to insure that a verbatim record of the proceeding is made which includes the testimony and evidence upon which the appeal is based, per Section 286.0105 F.S.
