NOTICE IS HEREBY given pursuant to an Order of Consent In Rem Final Summary Judgment of Mortgage Foreclosure dated June 26, 2014, entered in Case Number 2011-CA-010331-NC of the Circuit Court of the 12th Judicial Circuit in and for Sarasota County, Florida, wherein NOTE CAPITAL GROUP VENTURES, LLC, are the Plaintiffs, and SCOTT D. EICKMAN a/k/a SCOTT EICKMAN and HOLLY E. EICKMAN a/k/a HOLLY EICKMAN, his wife; FEDERAL DEPOSIT INSURANCE CORPORATION, as receiver of Century Bank; and IBERIA BANK; are the Defendants, I will sell to the highest and best bidder for cash at www.sarasota.realforeclose.com, the Clerk's website for on-line auctions at 9:00 o'clock a.m. on the 25th day of August, 2014, the following described property as set forth in said Order of Consent In Rem Final Summary Judgment of Mortgage Foreclosure, to wit:
BEING A PART OF THE SW 1/4 OF SECTION 13, TOWNSHIP 36 SOUTH, RANGE 19 EAST, SARASOTA COUNTY, FLORIDA MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCE AT THE SW CORNER OF SAID SECTION 13; THENCE N 02 DEGREES 03' 08” E ALONG THE WEST LINE OF SAID SW 1/4, A DISTANCE OF 331.62 FEET TO THE TRUE PLACE OF BEGINNING; THENCE CONTINUING N 02 DEGREES 03' 08” E ALONG SAID WEST LINE, SECTION 13 A DISTANCE OF 404.00 FEET; THENCE S 87 DEGREES 50' 29” E A DISTANCE OF 1272.89 FEET; THENCE S 01 DEGREES 55' 31” W, A DISTANCE OF 404.00 FEET; THENCE N 87 DEGREES 50' 29” W, A DISTANCE OF 1273.79 FEET TO THE WEST SECTION LINE OF SECTION 13, TO THE TRUE PLACE OF BEGINNING.
TOGETHER WITH AN INGRESS EGRESS EASEMENT BEING THE WEST 40 FEET OF THE NW 1/4 OF SECTION 24, TOWNSHIP 36 SOUTH, RANGE 19 EAST, SARASOTA COUNTY, FLORIDA LYING NORTH OF THE NORTH RIGHT-OF-WAY LINE OF FRUITVILLE ROAD.
AND ALSO:
BEING THE WEST 40 FEET OF THE SOUTH 1/2 OF THE SW 1/4 OF SECTION 13, TOWNSHIP 36 SOUTH, RANGE 19 EAST, SARASOTA COUNTY, FLORIDA.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
