NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated August 6, 2014 and entered in 2011-CA-055357 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE County, Florida, wherein Deutsche Bank National Trust Company, as Trustee for Ameriquest Mortgage Securities, Inc., Asset-Backed Pass-Through Certificate, Series 2005-R9, Under the Pooling and Servicing Agreement Dated October 1, 2005, is the Plaintiff and Unknown Heirs, Devisees, Grantees, Assignees, Creditors, Lienors, and Trustees of John Russell Yancey, Jr. Deceased, and All Other Persons Claiming by and Through, Under, Against The Named Defendant (s) are the Defendant(s). Linda Doggett as the Clerk of the Circuit Court will sell to the highest and best bidder for cash, www.lee.realforeclose.com, at 09:00 AM, on September 8, 2014, the following described property as set forth in said Final Judgment, to wit:
COMMENCE AT THE SOUTHWEST CORNER OF THE SOUTHEAST ONE-QUARTER (SOUTHEAST 1/4) OF THE NORTHWEST ONE-QUARTER (NORTHWEST 1/4) OF SECTION 27, TOWNSHIP 43 SOUTH, RANGE 27 EAST; THENCE RUN NORTH 01 DEGREES 32'35” WEST ALONG THE WESTERLY LINE Of GOVERNMENT LOT 3 IN SAID SECTION 27 FOR 943.44 FEET TO THE POINT OF BEGINNING OF THE HEREIN DESCRIBED PARCEL; THENCE CONTINUE NORTH 01 DEGREES 32'35” WEST ALONG SAID WESTERLY LINE FOR 183.22 FEET; THENCE RUN SOUTH 88 DEGREES 42'00” EAST FOR 237.83 FEET TO THE WESTERLY RIGHT-OF-WAY LINE OF BROADWAY ROAD (SR78); THENCE RUN SOUTH 01 DEGREES 37'50” EAST ALONG SAID RIGHT-OF-WAY LINE FOR 183.23 FEET; THENCE RUN NORTH 88 DEGREES 42'04” WEST FOR 238.10 FEET TO THE POINT OF BEGINNING. RESERVING AND CREATING AN EASEMENT FOR INGRESS AND EGRESS TO THE CALOOSAHATCHEE RIVER OVER AND ACROSS THE WESTERLY 30 FEET.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
