RAYMOND HERIE, UNKNOWN SPOUSE OF RAYMOND HERIE, JOHN DOE 1 and JOHN DOE 2, said fictitious names signifying any unknown parties in possession or occupying any portion of subject property,
Defendants.
TO: RAYMOND HERIE, whose last known address is 2291 Gulf to Bay Blvd., Lot 220, Clearwater, Florida 33765, and whose current residence is unknown; all parties claiming interests by, through, under or against the herein named individual defendants and the several and respective unknown assigns, successors in interest, trustees, and any other parties claiming by, through, under, or against any corporation or other legal entity named as a defendant, which parties may have or claim to have a right, title or interest in the property herein described; and ALL OTHERS WHOM IT MAY CONCERN:
YOU ARE NOTIFIED that Nicholas Peters has filed an action against you in the Circuit Court for Pinellas County to quiet title, related to certain real property located and situated in Pinellas County, Florida, and described as follows:
The submerged land lying between the Westwardly projected North and South boundaries of Lot 10, Spottis Woode, according to the plat thereof recorded in Plat Book 81, Page 57, of the Public Records of Pinellas County, Florida and the channel in Clearwater Bay.
Said land also being described as follows:
All of the submerged land West of Lot 10, Spottis Woode, Plat Book 81, Page 57, Public Records of Pinellas County, Florida, more particularly described as follows: Commence at the Northeast corner of Lot 8, as shown on the Plat of Shore Oaks Subdivision, as recorded in Plat Book 8, Page 35, of the Public Records of Pinellas County, Florida and go S. 89Ëš 47' 47'' W., 302.26 feet, along the North boundary of said Lot 8 to a point on the Mean High Water Line of Clearwater Bay (Clearwater Harbor), for a Point of Beginning; thence S. 10Ëš 50' 57'' W., 99.85 feet along said Mean High Water Line; thence S. 89Ëš 47' 47'' W., 785.48 feet, to the East side of the channel in Clearwater Bay; thence N. 02Ëš 29' 39'' E., 98.11 feet along the East side of the channel in Clearwater Bay to a point on the Westerly projection of the North boundary of the aforementioned Lot 8; thence N. 89Ëš 47' 47'' E., 800.00 feet along said Westerly projection of the North boundary of the aforementioned Lot 8 to the Point of Beginning.
Including the following:
(A) All of the land (the “Land”) in Pinellas County, Florida, described above, and made a part hereof, to have and to hold the same, together with all rights, privileges, tenements, hereditaments, rights-of-way, easements, appendages, projections appurtenances, water rights (including riparian and littoral rights), streets, ways, alleys, strips and gores of land now or hereafter in anyway belonging “ to, adjoining, appurtenant to, crossing, or pertaining to the Land.
(B) All buildings, betterments, structures, improvements and fixtures of any nature now or hereafter constructed or located, in whole or in part, on the Land, regardless of whether physically affixed thereto or now or hereafter severed or capable of severance from the Land (collectively, the “Improvements”).
This action is titled Nicholas Peters v. Raymond Herie, et al., Case Number 14-004409-CI. You are required to serve a copy of your written defenses, if any, on Brian C. Willis, Esq., of Shumaker, Loop & Kendrick, LLP, the Plaintiff's attorney, whose address is 101 East Kennedy Boulevard, Suite 2800, Tampa, Florida 33602, on or before twenty-eight (28) days after the date of first publication of this Notice of Action, and file the original with the clerk of this court either before service on the Plaintiff's attorney or immediately thereafter; otherwise a default will be entered against you for the relief demanded in the Complaint.
