NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated August 11, 2014, entered in Civil Case No.: 29-2012-CA-013089 of the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF THE CWABS, INC., ASSET-BACKED CERTIFICATES, SERIES 2005-1, Plaintiff, and JACQUELINE GONZALEZ, NORTH BAY VILLAGE CONDOMINIUM ASSOCIATION, INC., BAY PORT COLONY PROPERTY OWNERS ASSOCIATION, INC., HILLSBOROUGH COUNTY, FLORIDA, UNKNOWN TENANT IN POSSESSION # 1 N/K/A SAMANTHA SMITH, and ALL OTHER UNKNOWN PARTIES, including, if a named Defendant is deceased, the personal representatives, the surviving spouse, heirs, devisees, grantees, creditors, and all other parties claiming, by, through, under or against that Defendant, and all claimants, persons or parties, natural or corporate, or whose exact legal status is unknown, claiming under any of the above named or described Defendants, are Defendants.
PAT FRANK, The Clerk of the Circuit Court, will sell to the highest bidder for cash, www.hillsborough.realforeclose.com, at 10:00 AM, on the 29th day of September, 2014, the following described real property as set forth in said Final Summary Judgment, to wit:
CONDOMINIUM UNIT NO.10A-5, OF NORTH BAY VILLAGE, A CONDOMINIUM, ACCORDING TO THE PLAT THEREOF RECORDED IN CONDOMINIUM PLAT BOOK 2, PAGE 48, AND BEING FURTHER DESCRIBED IN THAT CERTAIN DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 3595, PAGE 385, AS MAY BE AMENDED, OF THE PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA; TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
