NOTICE IS HEREBY GIVEN pursuant to order rescheduling foreclosure sale or Final Judgment, entered in Civil Case No. 2013-CA-001837-NC of the Circuit Court of the 12th Judicial Circuit in and for Sarasota County, Florida, wherein The Bank of New York Mellon f/k/a The Bank of New York, as Trustee for the Holders of the Certificates, First Horizon Mortgage Pass-Through Certificates Series FH06-AA3, by First Horizon Home Loans, a Division of First Tennessee Bank, National Association, Master Servicer, in its Capacity as Agent for the Trustee Under the Pooling and Servicer Agreement, Plaintiff and Gary H. Marks a/k/a Gary Marks are defendant(s), I, Clerk of Court, Karen E. Rushing, will sell to the highest and best bidder for cash VIA THE INTERNET AT WWW.SARASOTA.REALFORECLOSE.COM , AT 9:00 A.M. on January 8, 2015, the following described property as set forth in said Final Judgment, to-wit:
UNIT 436, BUILDING C, BELLA VILLINO VI, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN THE OFFICIAL RECORDS AS INSTRUMENT # 2005229158, AND AS PER PLAT THEREOF, RECORDED IN CONDOMINIUM BOOK 38, PAGE 19, PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
