NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order or Final Summary Judgment. Final Judgment was awarded on in Civil Case No. 14-CA-050516, of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE County, Florida, wherein, BANK OF NEW YORK MELLON, F/K/A THE BANK OF NEW YORK, AS TRUSTEE, ON BEHALF OF THE HOLDERS OF THE ALTERNATIVE LOAN TRUST 2006-OA2, MORTGAGE PASS THROUGH CERTIFICATES SERIES 2006-OA2 is the Plaintiff, and MARC D. NEELEY A/K/A MARC DAVID NEELEY; SHERRI R. NEELEY A/K/A SHERRI R. STENING; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.
The clerk of the court will sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 AM on January 21, 2015, the following described real property as set forth in said Final summary Judgment, to wit:
LOT 42, BLOCK D, OF THAT CERTIN SUBDIVISION KNOWN AS COTTAGE POINT, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 9, PAGE 133, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, AND ACCORDING TO THE PLAT THEREOF WHICH IS MADE A PART OF A DEED RECORDED IN DEED BOOK 259, PAGE 224, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
