NOTICE IS HEREBY GIVEN that sale will be made pursuant to an Order or Final Summary Judgment. Final Judgment was awarded on in Civil Case No. 12-CA-056246, of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE County, Florida, wherein, THE BANK OF NEW YORK MELLON, FKA THE BANK OF NEW YORK AS SUCCESSOR IN INTEREST TO JP MORGAN CHASE BANK NA AS TRUSTEE FOR STRUCTURED ASSET MORTGAGE INVESTMENTS II INC. BEAR STEARNS ALT-A TRUST 2004-10 is the Plaintiff, and LLOYD R. FREDENDALL A/K/A LLOYD FREDENDALL; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS
NOMINEE FOR DREAM; are Defendants.
The clerk of the court, Linda Doggett will sell to the highest bidder for cash www.lee.realforeclose.com at 9:00 a.m. on the 14 day of January, 2015, the following described real property as set forth in said Final summary Judgment, to wit:
BEGINNING AT THE SOUTHEAST CORNER OF SECTION 32, TOWNSHIP 47 SOUTH, RANGE 25 EAST, RUN WEST ALONG THE SOUTH LINE OF SAID SECTION FOR 665 FEET, THENCE NORTH 50 FEET TO THE NORTH LINE OF THE BONITA BEACH ROAD, THENCE CONTINUE ON THE SAME COURSE ON THE CENTER LINE OF A ROAD 130 FEET WIDE FOR 880 FEET TO THE SOUTH LINE OF A ROAD 50 FEET WIDE, THENCE WEST ALONG THE SOUTH LINE OF SAID 50 FOOT WIDE ROAD FOR 305 FEET TO THE POINT OF BEGINNING OF THE LAND HEREIN CONVEYED. THENCE SOUTH 130 FEET, THENCE WEST 120 FEET, THENCE NORTH 130 FEET TO THE SOUTH LINE OF A ROAD 50 FEET WIDE, THENCE EAST ALONG THE SOUTH LINE OF SAID 50 FOOT WIDE ROAD FOR 120 FEET TO THE POINT OF BEGINNING OF THE LAND HEREIN CONVEYED, LEE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
