NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure filed January 24, 2014, and entered in 12-CA-050364 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE, SUCCESSOR IN INTEREST TO WACHOVIA BANK, N.A., AS TRUSTEE FOR MASTR ALTERNATIVE LOAN TRUST 2004-9, is the Plaintiff and JOHN R. SEGROVES JR. A/K/A JOHN RUSSELL SEGROVES JR.; MARIO COSTANTINI INDIVIDUALLY AND AS TRUSTEE OF THE MARIO COSTANTINI TRUST AGREEMENT DATED THE 13TH DAY OF JULY, 2000; WELLS FARGO BANK, N.A. AS SUCCESSOR TO WACHOVIA BANK, N.A.; UNKNOWN TENANT(S) are the Defendant(s). Linda Doggett as the Clerk of the Circuit Court will sell to the highest and best bidder for cash, www.lee.realforeclose.com, at 09:00 AM on March 26, 2014, the following described property as set forth in said Final Judgment, to wit:
A LOT OR PARCEL OF LAND LYING IN LOT 65 OF ARROYAL SUBDIVISION, SECTION 33, TOWNSHIP 47 SOUTH, RANGE 25 EAST, LEE COUNTY, FLORIDA AS RECORDED IN PLAT BOOK 3, PAGE 80, LEE COUNTY RECORDS, WHICH LOT OR PARCEL IS DESCRIBED AS FOLLOWS:
FROM THE NORTHWEST CORNER OF SAID LOT 65 RUNS S 02°10'00'' E ALONG THE WEST LINE OF SAID LOT FOR 140 FEET; THENCE RUN NORTH 87°35'50'' E, PARALLEL WITH THE NORTH LINE OF SAID LOT ALONG THE NORTH LINE OF A ROADWAY EASEMENT 50 FEET WIDE FOR 215 FEET TO THE POINT OF BEGINNING. FROM SAID POINT OF BEGINNING CONTINUE N 87°35'50” E ALONG THE NORTH LINE OF SAID ROADWAY EASEMENT FOR 80 FEET; THENCE RUN N 02°55'10” W, PARALLEL WITH THE EASTERLY LINE OF SAID LOT FOR 120 FEET; THENCE RUN S02°55'10” E, PARALLEL WITH SAID EAST LINE FOR 120 FEET TO THE POINT OF BEGINNING.
CONTAINING 0.22 ACRES MORE OR LESS, TOGETHER WITH THE HEREINABOVE DESCRIBED ROADWAY EASEMENT 50 FEET WIDE.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
