NOTICE IS HEREBY GIVEN pursuant to a Final Judgment dated October 28, 2013, entered in Civil Case No.: 52-2009-CA-007716, DIVISION: 11, of the Circuit Court of the SIXTH Judicial Circuit in and for Pinellas County, Florida, wherein FEDERAL NATIONAL MORTGAGE ASSOCIATION is Plaintiff, and DONALD J. SMITH A/K/A DONALD SMITH; UNKNOWN SPOUSE OF DONALD J. SMITH A/K/A DONALD SMITH IF ANY; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER, AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; UNITED GUARANTY RESIDENTIAL INSURANCE COMPANY OF NORTH CAROLINA; TARHEEL ROOFING, INC.; BANK OF AMERICA, N.A.; WILLOW POINT CONDOMINIUM ASSOCIATION, INC.; JOHN DOE AND JANE DOE AS UNKNOWN TENANTS IN POSSESSION, are Defendant(s).
KEN BURKE, the Clerk of Court shall sell to the highest bidder for cash at 10:00 a.m., online at www.pinellas.realforeclose.com, on the 25th day of February, 2014 the following described real property as set forth in said Final Summary Judgment, to wit:
UNIT NO. 10174, BUILDING 7, WILLOW POINT CONDOMINIUM PHASE III, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS BOOK 5039, PAGE 1699 AND ANY AMENDMENTS MADE THERETO AND AS RECORDED IN CONDOMINIUM PLAT BOOK 42, PAGE 95-101, OF THE PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
