NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure filed February 7, 2014 entered in Civil Case No. 36-2012-CA-057174 of the Circuit Court of the TWENTIETH Judicial Circuit in and for Lee County, Ft. Myers, Florida, the Clerk of Court will sell to the highest and best bidder for cash at www.lee.realforeclose.com in accordance with Chapter 45 Florida Statutes at 9:00 am on 10 day of March, 2014 on the following described property as set forth in said Summary Final Judgment:
Lot 46 West, being a lot or parcel of land lying in Lot 46, Phase III The Dunes at Sanibel Island, Section 19, Township 46 South, Range 23 East, City of Sanibel, Florida as shown on Sheet 8 of plat recorded in Plat Book 34, Page 104, Lee County, Florida, which lot or parcel is described as follows:
From the northeasterly corner of said Lot 46, run N 81Ëš 23' 00”W, along the northerly line of said lot for 44.48 feet to the Point of Beginning; From said Point of Beginning run S 08° 37'00”W along the centerline of a maintenance easement, 8 feet wide, for 44.87 feet to an intersection with the northeasterly prolongation of the centerline of a party wall of a duplex structure under construction; thence run SËš 21 20'20”W along said prolongation, said centerline of the party wall and the centerline of said maintenance easement for 50.90 feet; thence run S 08Ëš37'00”W along the centerline of said maintenance easement for 45.48 feet to the southerly line of said Lot 46; thence run N 81Ëš23'00”W along said southerly line for 44.31 feet to the southwesterly corner of said lot; thence run N 08Ëš37'00”E, along the westerly line of said lot for 140 feet to the northwest corner of said lot; thence run S 81Ëš23'00”E, along the northerly line of said lot and the southerly line of Sandcastle Road for 55.52 feet to the Point of Beginning.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens, must file a claim within 60 days after the sale.
