NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure dated 02/07/2014, and entered in Case No. 13-CA-053462 of the Circuit Court of the 20th Judicial Circuit, in and for LEE County, Florida, where in M&T BANK, is the Plaintiff and RICHARD L. BARBER, UNKNOWN TENANT #1 n/k/a RICHARD BARBER, JR., are the Defendants, the Clerk of Court shall offer for sale to the highest bidder for cash on March 10, 2014, beginning at 9:00 A.M., at www.lee.realforeclose.com, the following described property as set forth in said Summary Final Judgment lying and being situate in LEE County, Florida, to wit:
Lots 16 and 17, Block 702, CAPE CORAL SUBDIVISION UNIT 21, a subdivision according to the plat thereof, as recorded in Plat Book 13, Pages 149 through 173 inclusive, in the Public Records of Lee County, Florida.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a etun of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale. THE CLERK SHALL RECEIVE A SERVICE CHARGE OF UP TO $70 FOR SERVICES IN MAKING, RECORDING, AND CERTIFYING THE SALE AND TITLE THAT SHALL BE ASSESSED AS COSTS. THE COURT, IN ITS DISCRETION, MAY ENLARGE THE TIME OF THE SALE. NOTICE OF THE CHANGED TIME OF SALE SHALL BE PUBLISHED AS PROVIDED HEREIN.
