NOTICE IS HEREBY GIVEN pursuant to an Order rescheduling foreclosure sale, entered in Civil Case No. 52-2011-CA-009808 of the Circuit Court of the 6th Judicial Circuit in and for Pinellas County, Florida, wherein U.S. Bank, National Association, as Indenture Trustee of the HomeBanc Mortgage Trust 2005-1, Plaintiff and Christian W. Smith, Jr. a/k/a Christian W. Smith are defendant(s), I, Clerk of Court, Ken Burke, will sell to the highest and best bidder for cash at www.pinellas.realforeclose.com, at 10:00 A.M. on April 3, 2014, the following described property as set forth in said Final Judgment, to-wit:
LOT 41, RIVERSIDE, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 94, PAGES 85-88, INCLUSIVE, PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA, TOGETHER WITH ADJOINING “HAMMOCK AREA” DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEASTERLY CORNER OF SAID LOT 41, FOR A POINT OF BEGINNING AND RUN THENCE NORTH 75 DEGREES 36 MINUTES 20 SECONDS EAST, 221.02 FEET, ALONG THE NORTHERLY LINE OF LOT 41 EXTENDED, THENCE SOUTH 12 DEGREES 00 MINUTES 00 SECONDS WEST, 205.94 FEET, TO A POINT ON THE EAST LINE OF LOT 41, 39.32 FEET, NORTHERLY OF THE SOUTHEAST CORNER OF SAID LOT 41, THENCE ALONG THE EASTERLY LINE OF LOT 41, TO THE POINT OF BEGINNING.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
