NOTICE IS HEREBY GIVEN pursuant to a Final Judgment dated December 3, 2013, entered in Civil Case No.: 2009 CA 013945 NC, Division: C of the Circuit Court of the TWELFTH Judicial Circuit in and for SARASOTA County, Florida, wherein HSBC BANK USA, N.A., AS TRUSTEE ON BEHALF OF ACE SECURITIES CORP. HOME EQUITY LOAN TRUST AND FOR THE REGISTERED HOLDERS OF ACE SECURITIES CORP. HOME EQUITY LOAN TRUST, SERIES 2007-HE5, ASSET BACKED PASS-THROUGH CERTIFICATES, is Plaintiff, and CHRISTOPHER J. MCDONALD A/K/A CHRIS J. MCDONALD; CHARRISE MCDONALD A/K/A CHARRISE N. MCDONALD; CHASE BANK USA, N.A.; SARASOTA COUNTY CLERK OF COURT; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendants.
KAREN E. RUSHING, the Clerk of Court shall sell to the highest bidder for cash online at www.Sarasota.Realforeclose.Com at 9:00 a.m. on the 14th day of January, 2014 the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 3, BLOCK 487, 8TH ADDITION TO PORT CHARLOTTE SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 12, PAGES 20 THROUGH 20Z2, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
