NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of foreclosure dated December 20th, 2013, and entered in Case No. 13-CA-050073 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein GMAC MORTGAGE, LLC, is Plaintiff, and CARL KIELBASA, AS SUCCESSOR TRUSTEE OF THE STEPHEN F. MULLADY DECLARATION OF TRUST DATED JUNE 3, 2005, et al are Defendants, the clerk will sell to the highest and best bidder for cash, beginning at 9:00 am at www.lee.realforeclose.com, in accordance with Chapter 45, Florida Statutes, on the 24 day of January, 2014, the following described property as set forth in said Summary Final Judgment, to wit:
Lots 36 AND 37, BLOCK 36, UNIT 6, PART 3, CAPE CORAL SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 11, PAGES 70 TO 79, INCLUSIVE IN THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.A PORTION OF WILLSHIRE CANAL, LYING ADJACENT TO Lots 36 AND 37, BLOCK 36, CAPE CORAL UNIT SIX, PART THREE, ACCORDING TO PLAT BOOK 11, PAGES 70 THROUGH 79 OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, BEING DESCRIBED AS FOLLOWS:BEGINNING AT THE Southwest CORNER OF SAID Lot 36; THENCE RUN N 90 DEGREES 00 MINUTE 00 SECOND E ALONG THE South LINE OF SAID Lots 36 AND 37 FOR 80.03 FEET TO THE Southeast CORNER OF SAID Lot 37; THENCE RUN S 00 DEGREE 00 MINUTE 00 SECOND W ALONG THE Southerly PROLONGATION OF THE East LINE OF SAID Lot 37 FOR 4.06 FEET TO A POINT OF INTERSECTION WITH THE FACE OF AN EXISTING SEAWALL; THENCE RUN N 89 DEGREES 46 MINUTES 41 SECONDS W ALONG SAID FACE FOR 80.03 FEET TO A POINT OF INTERSECTION WITH THE Southerly PROLONGATION OF THE West LINE OF SAID Lot 36; THENCE RUN N 00 DEGREE 00 MINUTE 00 SECOND E ALONG SAID PROLONGATION FOR 3.75 FEET TO THE POINT OF BEGINNING.SAID PARCEL CONTAINS 313 SQUARE FEET, MORE OR LESS.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
