NOTICE IS HEREBY GIVEN pursuant to a Final Judgment dated December 16, 2013, entered in Civil Case No.: 2013 CA 001761 NC, DIVISION: C of the Circuit Court of the TWELFTH Judicial Circuit in and for SARASOTA County, Florida, wherein EVERBANK, is Plaintiff, and GREGORY E. HARRIS SR. A/K/A GREGORY E. HARRIS; GWENDOLYN HARRIS; THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS SUCCESSOR TRUSTEE TO JPMORGAN CHASE BANK, N.A., AS TRUSTEE ON BEHALF OF THE CERTIFICATEHOLDERS OF THE CWHEQ INC., CWHEQ REVOLVING HOME EQUITY LOAN TRUST, SERIES 2005-M; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendants.
KAREN E. RUSHING, the Clerk of Court shall sell to the highest bidder for cash online at Www.Sarasota.Realforeclose.Com at 9:00 a.m. on the 30 day of January, 2014 the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 573, KENSINGTON PARK SUBDIVISION, UNIT NO. 5, AS PER PLAT THEREOF RECORDED IN PLAT BOOK 11, PAGES 9 AND 9A, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
