AGENCY ACTION
The Florida Department of Environmental Protection (FDEP) gives notice that it proposes to approve use of an interim institutional control in the form of a Declaration of Restrictive Covenant at a contaminated site while site rehabilitation is ongoing. A&S Oil Recovery of Florida, Inc. is seeking this Declaration in reference to FDEP Site ID # FAC ID 9201304, A&S Oil Recovery of Florida, 4601 8th Ave. South, St. Petersburg, FL, and intends to restrict exposure to contamination in the following manner: land use restriction, water use restriction, and cap over contaminated soil.
Complete copies of the draft Declaration of Restrictive Covenant and FDEP's preliminary evaluation are available for public inspection during normal business hours 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays at the Pinellas County Health Department, 8751 Ulmerton Road, Suite 2000, Largo, Florida 33771, attn: Andrew Moore.
Local governments with jurisdiction over the property subject to the institutional control, real property owner(s) of any property subject to the institutional control, and residents of any property subject to the institutional control have 30 days from publication of this notice to provide comments to FDEP. Such comments must be sent to Pinellas County Health Department, 8751 Ulmerton Road, Suite 2000, Largo, Florida 33771 , attn: Andrew Moore; or via email to [email protected].
