NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 27 day of May, 2014, and entered in Case No. 13001945CA, of the Circuit Court of the 20TH Judicial Circuit in and for Charlotte County, Florida, wherein WELLS FARGO BANK, NATIONAL ASSOCIATION AS TRUSTEE FOR STRUCTURED ASSET MORTGAGE INVESTMENTS II INC., BEAR STEARNS MORTGAGE FUNDING TRUST 2007-AR2, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2007-AR2 is the Plaintiff and ROBERT OSBORNE CITIBANK, N.A. AS TRUSTEE FOR CERTIFICATEHOLDERS OF BEAR STEARNS SECOND LIEN TRUST 2007-1, MORTGAGE-BACKED CERTIFICATES, SERIES 2007-1P THREE MARTINI'S LLC. DONNA OSBORNE UNKNOWN SPOUSE OF MARJORIE S BROWN; and UNKNOWN TENANT IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.charlotte.realforeclose.com in accordance with Chapter 45, Florida Statutes at, 11:00 AM on the 2 day of July, 2014, the following described property as set forth in said Final Judgment, to wit:
LOT 27 AND THE FOLLOWING DESCRIBED PARCEL OF LOT 28: TAKE FOR A POINT-OF-BEGINNING THE FRONT LOT CORNER OF LOTS 27 AND 28; GO SOUTHEASTERLY ALONG THE FRONT LINE OF LOT 28 THROUGH AN ARC OF 4 FEET AND A CENTRAL ANGLE OF 0°43'39”; GO THENCE SOUTHWESTERLY 120 FEET TO A POINT ON THE REAR LINE OF LOT 28; GO THENCE NORTHWESTERLY ALONG SAID LINE THROUGH AN ARC OF 7.60 FEET AND A CENTRAL ANGLE OF 1°00'04” TO THE REAR CORNER OF LOTS 27 & 28; GO THENCE NORTHEASTERLY ALONG THE LINE OF 27 & 28, 120 FEET TO THE POINT OF BEGINNING. PARCEL LIES IN BLOCK 215, PUNTA GORDA ISLES, SECTION 14, PLAT BOOK 8, PAGES 9A THROUGH 9Q, OF THE PUBLIC RECORDS OF CHARLOTTE COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
