NOTICE IS HEREBY GIVEN that the undersigned, the Clerk of the Circuit Court for Manatee County, Florida, under and pursuant to the Uniform Final Judgment of Mortgage Foreclosure heretofore entered on the 3rd day of February, 2014, and the Order Granting Plaintiff's Ex Parte Motion to Reset Foreclosure Sale dated March 6, 2014, in that certain cause pending in the Circuit Court of the Twelfth Judicial Circuit, in and for Manatee County, Florida, with case number 41 2009 CA 012233, in which Emigrant Mortgage Company, Inc., is the Plaintiff, and Amanda M. Menendez, as Personal Representative of the Estate of deceased, Mary E. Menendez, and individually as heir to the Estate of Deceased, Amber Menendez Isaac, as Personal Representative of the Estate of Deceased, and individually as heir to the Estate of Deceased, James A. Menendez, as heir to the Estate of Deceased, Bradd A. Menendez, as heir to Estate of Deceased, Douglas D. Menendez, as heir to Estate of Deceased, Bank United, FSB, Bruce S. Latimer, and First in Care Home Health Agency, Inc. are the Defendants, and under and pursuant to the terms of the said Uniform Final Judgment of Mortgage Foreclosure will offer for sale at public outcry to the highest and best bidder for cash, except as set out hereinafter, via the Internet at www.manatee.realforeclose.com, on the 10th day of April, 2014, at 11:00 a.m., the same being a legal sales day and the hour a legal hour of sale, the real and personal property situated in Manatee County, Florida and legally described as follows:
Property Legal Description:
The North 1⁄2 of Lot 3, Block 3, CASANAS SUBDIVISION, according to the plat thereof recorded in Plat Book 1, Page 176, of the Public Records of Manatee County, Florida
The property aforesaid, together with all improvements, buildings, fixtures, tenements, hereditaments and appurtenances thereto belonging, or in anywise appertaining, is being sold to satisfy Plaintiff's claims under said Judgment.
Any person claiming interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
