NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure sale filed March 11, 2014 and Final Summary Judgment dated February 5, 2014 entered in Civil Case No.: 36-2013-CA-050253 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein ONEWEST BANK, F.S.B., is Plaintiff, and THE UNKNOWN SPOUSE, HEIRS, DEVISEES, GRANTEES, ASSIGNEES, LIENORS, CREDITORS, TRUSTEES AND ALL OTHERS WHO MAY CLAIM AN INTEREST IN THE ESTATE OF THEDA IRIS MCCLEERY, DECEASED; JOHN COBB; DENNIS COBB; SCOTT MCCLEERY; UNITED STATES OF AMERICA, ACTING ON BEHALF OF THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS,, are Defendants.
LINDA DOGGETT, the Clerk of Court shall sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 10 day of April, 2014 the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 7, BLOCK 1, UNIT 1, PONDELLA HEIGHTS, A SUBDIVISION ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND RECORDED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF LEE COUNTY, FLORIDA, IN PLAT BOOK 11, PAGE 52.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
