Final Judgment was awarded on in Civil Case No. 12-CA-51877 , of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE County, Florida, wherein, DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR HSI ASSET SECURITIZATION CORPORATION TRUST, 2007-HE2, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2007-HE2 is the Plaintiff, and JOHN K. FRANTA, PA, AS TRUSTEE AND NOT PERSONALLY UNDER THE PROVISIONS; LEIGHTON A. SMITH; AMY D. SMITH; UNKNOWN TENANT #1; UNKNOWN TENANT #2; are Defendants.
The clerk of the court, Linda Doggett will sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 14 day of April, 2014, the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 3, BLOCK F, TWIN PALM ESTATES, A SUBDIVISION ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 6, PAGE 71, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, EXCEPTING THEREFROM THE FOLLOWING DESCRIBED PART OR PARCEL THEREOF:
FROM THE SOUTHWEST CORNER OF SAID LOT 3, PROCEED IN AN EASTERLY DIRECTION, ALONG THE BOUNDARY LINE BETWEEN LOTS 3 AND 4, OF SAID BLOCK F, FOR A DISTANCE OF 44 FEET TO THE POINT OF BEGINNING OF THE LANDS HEREIN EXCEPTED; THENCE PROCEED IN THE SAME DIRECTION, ON THE AFORESAID BOUNDARY LINE, TO THE WESTERLY BOUNDARY LINE INTERSECTION WITH LOT 2, OF SAID BLOCK F; THENCE RUN NORTHERLY, ALONG THE EASTERLY BOUNDARY OF SAID LOT 3, FOR A DISTANCE OF 10 FEET ; THENCE RUN WESTERLY TO THE POINT OF BEGINNING OF THE LANDS HEREIN EXCEPTED, SAID POINT BEING 44 FEET FROM THE AFORESAID SOUTHWESTERLY CORNER OF SAID LOT 3.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
