NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure dated February 3, 2014, and entered in Case No. 10-CA-051286 of the Circuit Court of the 20th Judicial Circuit, in and for LEE County, Florida, where in THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE ALTERNATIVE LOAN TRUST 2007-HY3 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2007-HY3, is the Plaintiff and CURTIS CALVIN SHOKES, is the Defendant, the Clerk will offer for sale to the highest bidder for cash on May 23, 2014, at 9:00 A.M., at ww.lee.realforeclose.com, the following described property as set forth in said Summary Final Judgment lying and being situate in LEE County, Florida, to wit:
Lot(s) 41 and 42, Block 1669, CAPE CORAL SUBDIVISION UNIT 64, according to the plat recorded in Plat Book 21, Page(s) 82 to 95 inclusive, in the Public Records of Lee County, Florida.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale. THE CLERK SHALL RECEIVE A SERVICE CHARGE OF UP TO $70 FOR SERVICES IN MAKING, RECORDING, AND CERTIFYING THE SALE AND TITLE THAT SHALL BE ASSESSED AS COSTS. THE COURT, IN ITS DISCRETION, MAY ENLARGE THE TIME OF THE SALE. NOTICE OF THE CHANGED TIME OF SALE SHALL BE PUBLISHED AS PROVIDED HEREIN.
