NOTICE IS HEREBY GIVEN pursuant to a Final Judgment dated April 2, 2014, entered in Civil Case No.: 13-CA-008937, DIVISION: , of the Circuit Court of the THIRTEENTH Judicial Circuit in and for Hillsborough County, Florida, wherein ONEWEST BANK, F.S.B. is Plaintiff, and THE UNKNOWN SPOUSE, HEIRS, BENEFICIARIES, DEVISEES, GRANTEES, ASSIGNEES, LIENOR, CREDITORS, TRUSTEES, AND ALL OTHER PARTIES CLAIMING AN INTEREST BY, THROUGH, UNDER OR AGAINST THE ESTATE OF EDWARD F. SPIVEY, DECEASED; JOANIE L. LAVELLEY; SHERYL CUNNINGHAM; UNITED STATES OF AMERICA, ACTING ON BEHALF OF THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT; GREAT SENECA FINANCIAL CORPORATION, A DISSOLVED MARYLAND CORPORATION; KAREN HEINBERG; STATE OF FLORIDA, DEPARTMENT OF REVENUE; CLERK OF THE CIRCUIT COURT OF HILLSBOROUGH COUNTY, FLORIDA; TEMPLE TERRACE PRESBYTERIAN CHURCH, INC.; LADONNA SCRUGGS; UNKNOWN TENANT #1; UNKNOWN TENANT #2; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendant(s).
PAT FRANK, the Clerk of Court shall sell to the highest bidder for cash at 10:00 AM, at www.hillsborough.realforeclose.com, on the 21st day of May, 2014, the following described real property as set forth in said Final Summary Judgment, to wit:
THE NORTH 80 FEET OF THE SOUTH 621 FEET OF LOT 76 OF REVISED MAP OF FLORIDA GARDENLANDS SUBDIVISION, ACCORDING TO THE MAP OR PLAT THEREOF, AS RECORDED IN PLAT BOOK 6, PAGES 42 AND 43 PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA; LESS THE EAST 50 FEET FOR ROAD RIGHT OF WAY.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
