NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure dated 09/04/2014, and entered in Case No. 2013 CA 007028 NC of the Circuit Court of the 12th Judicial Circuit, in and for SARASOTA County, Florida, where in THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS CWMBS, INC. MORTGAGE PASS-THROUGH TRUST 2005-HYB7, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-HYB7, is the Plaintiff and JULIAN A. MCCANN, INDIVIDUALLY, UNKNOWN SPOUSE OF JULIAN A. MCCANN, JULIAN A. MCCANN, TRUSTEE OF THE JULIAN A. MCCANN TRUST DATED 2/4/05, UNKNOWN TENANT #1 n/k/a DONNA GONZALEZ, UNKNOWN TENANT #2 n/k/a QUEEN MARTIN, are the Defendants, the Clerk of Court shall offer for sale to the highest bidder for cash on January 7, 2015, beginning at 9:00 A.M., at www.sarasota.realforeclose.com, the following described property as set forth in said Summary Final Judgment lying and being situate in SARASOTA County, Florida, to wit:
Lot 6, Block A, HILLCREST, SECOND EDITION, according to the Plat thereof recorded in Plat Book 1, Page 37, of the Public Records of Sarasota County, Florida.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE. THE CLERK SHALL RECEIVE A SERVICE CHARGE OF UP TO $70 FOR SERVICES IN MAKING, RECORDING, AND CERTIFYING THE SALE AND TITLE THAT SHALL BE ASSESSED AS COSTS. THE COURT, IN ITS DISCRETION, MAY ENLARGE THE TIME OF THE SALE. NOTICE OF THE CHANGED TIME OF SALE SHALL BE PUBLISHED AS PROVIDED HEREIN.
