Plaintiff, DISASTER RESTORATION SPECIALIST sues Defendant STEFICA SESTAK to Foreclose on a Judgment
1. This is an action against the Defendant, STEFICA SESTAK to foreclose a judgment lien on non-homestead real property located in Pinellas County, Florida.
2. The Defendant, STEFICA SESTAK, is the owner of the following described non-homestead real property located at property located at 1235 South Highland Avenue, #C-203, Clearwater, FL.
3. On or about June 5, 2010, SESTAK executed a contract with DRS to provide labor and services for a fee on real property located at 1235 South Highland Avenue, #C-203, Clearwater, FL
4. On March 27, 2013 a judgment was entered by the Court in the amount of $5,650.00.
5. The judgment recorded with the Pinellas County Clerk of Circuit Court on Official Record Book 17530, Page 2264. See Attached Exhibit “A”
6. Defendant has refused to pay the balance owed to the Plaintiff.

FORECLOSURE
7. Plaintiff realleges paragraphs 1 through 6 above as if fully set forth herein.
8. There is due and owing by the Defendant to the Plaintiff the sum of $5,650.00 plus interest, costs and reasonable attorney fees. Accordingly, the Plaintiff recorded Judgment with the Clerk of Circuit Court in Pinellas County, Florida at Official Record Book 17530, Page 2264 on March 27, 2012, a copy of which is attached as Exhibit “A”.

THIS CAUSE came before this Court upon the Plaintiff Motion for Summary Judgment on a complaint for Breach of Contract and Unjust Enrichment and the Court being otherwise advised and hearing arguments, it is hereby:
ORDERED AND ADJUDGED
1. Plaintiff's Motion for Summary Judgment is GRANTED
2. That DISASTER RESTORATION SPECIALIST, INC., is awarded $4,900 dollars in damages.
3. That DISASTER RESTORATION SPECIALIST, INC., is awarded $750.00 in attorney fees and $360.00 in fees and costs.
DONE AND ORDERED at Clearwater, Pinellas County Florida on March, 23, 2012.

9. The Defendant owes the Plaintiff $5,650.00 under the Judgment that is due since March 27, 2012, plus interest, costs and reasonable attorney fees.
WHEREFORE, the Plaintiff DISASTER RESTORATION SPECIALIST, INC requests this Honorable Court to (1) adjudicate that Plaintiff has a valid Judgment on the above described property, for the unpaid balance, plus interest, (2) is in default of payment of the amount due by the Defendant, order the property be sold by the Clerk of Court at a judicial sale pursuant to Chapter 45, Fla. Stat. (2006); and award to Plaintiff any other relief as the Court deems equitable, necessary and proper.
