NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure entered July 21, 2015 in Civil Case No. 14-007243-CI of the Circuit Court of the SIXTH Judicial Circuit in and for Pinellas County, Clearwater, Florida, wherein BANC OF AMERICA FUNDING CORPORATION MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2004-D, U.S. BANK NATIONAL ASSOCIATION, AS TRUSTEE, SUCCESSOR IN INTEREST TO WACHOVIA BANK, NATIONAL ASSOCIATION, AS TRUSTEE is Plaintiff and THE UNKNOWN TRUSTEES OF THE VIRGINIA B. FRANKS TRUST DATED NOVEMBER 12, 2002, ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE ESTATE OF VIRGINIA B. FRANKS, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS TRUSTEES, BENEFICIARIES, OR OTHER CLAIMANTS , STATE OF FLORIDA DEPARTMENT OF REVENUE, UNITED STATES OF AMERICA, DEPARTMENT OF THE TREASURY - INTERNAL REVENUE SERVICE, BELLEVIEW BILTMORE VILLAS-SOUTH GARDEN-4 BELLEVIEW BLVD., INC., JOHN L. FRANKS, JR., KERRI SMOAK, UNKNOWN TENANT IN POSSESSION 1, UNKNOWN TENANT IN POSSESSION 2, UNKNOWN SPOUSE OF JOHN L. FRANKS, JR., UNKNOWN SPOUSE OF KERRI SMOAK, unknown trustees, settlers and beneficiaries of The Virginia B. Franks Trust dated November 12, 2002 are Defendants, the Clerk of Court will sell to the highest and best bidder for cash electronically at www.pinellas.realforeclose.com in accordance with Chapter 45, Florida Statutes on the 4th day of September, 2015 at 10:00 AM on the following described property as set forth in said Summary Final Judgment, to-wit:
Unit 102, Belleview Biltmore Villas - South Garden - 4 Belleview Blvd., a Condominium, together with an undivided interest in the common elements, according to the Declaration of Condominium thereof recorded in Official Record Book 4762, Page 1967 through 2016, and any amendments thereto, according to the plat thereof recorded in Condominium Plat Book 30, Pages 83 through 90, as amended from time to time, of the Public Records of Pinellas County, Florida.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens, must file a claim within 60 days after the sale.
