NOTICE IS HEREBY GIVEN pursuant to an Order or Summary Final Judgment of foreclosure dated 5/21/2015 and an Order Resetting Sale dated July 29, 2015, and entered in Case No. 11-2014-CA-000616 112014CA0006160001XX of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein THE BANK OF NEW YORK MELLON, AS INDENTURE TRUSTEE FOR ENCORE CREDIT RECEIVABLES TRUST 2005-1 is Plaintiff and OMAR RAUL GARCIA; COLLIER COUNTY, FLORIDA; MORTGAGE ELECTRONIC SYSTEMS, INC. AS NOMINEE FOR ENCORE CREDIT CORPORATION AND TENANT; and ALL UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER OR AGAINST A NAMED DEFENDANT TO THIS ACTION, OR HAVING OR CLAIMING TO HAVE ANY RIGHT, TITLE OR INTEREST IN THE PROPERTY HEREIN DESCRIBED, are Defendants, I will sell to the highest and best bidder for cash at the lobby on the third floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, FL 34112., at 11:00 a.m. on the 16 day of September, 2015, the following described property as set forth in said Order or Final Judgment, to-wit:
THE SOUTH HALF OF TRACT #30 FROM AN UNRECORDED PLAT, MORE OR LESS. BEGINNING AT SOUTHEAST CORNER OF SECTION 12, NORTH 2482.50 FEET TO POINT BEING POINT OF BEGINNING. THENCE SOUTH 89 DEGREES 49'45” WEST 1364.32 FEET; THENCE NORTH 0 DEGREES 13'30” EAST 165.00 FEET; THENCE NORTH 89 DEGREES 49'45” EAST FOR 1363.97 FEET; THENCE SOUTH 165.00 FEET TO POINT OF BEGINNING IN SECTION 12, TOWNSHIP 51 SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA, LESS AND EXCEPTING THE EAST 30 FEET THEREOF.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
