NOTICE OF ACTION
AS TO HARSH MEHTA
IN THE CIRCUIT COURT OF THE SIXTH JUDICIAL CIRCUIT IN AND FOR PASCO COUNTY, FLORIDA
CIVIL DIVISION
Case No. 2015-CA-000364-WS
BAY CITIES BANK, as
successor-in-interest to PROGRESS BANK OF FLORIDA, by asset
acquisition from the FDIC as receiver for PROGRESS BANK OF FLORIDA,
Plaintiff, vs.
AM HEALTHCARE, LLC, a
Florida limited liability company, and HARSH MEHTA, individually,
Defendants.
PLEASE TAKE NOTICE THAT Bay Cities Bank, as successor-in-interest to Progress Bank of Florida by asset acquisition from the FDIC as receiver for Progress Bank of Florida (the “Bank” or the “Plaintiff'), by and through its attorneys, filed a complaint (the “Complaint”) in the Sixth Judicial Circuit in and for Pasco County, Florida, thereby initiating the above-captioned action (this “Action”).
1. Pursuant to the Complaint, the Bank seeks relief against defendant, Harsh Mehta, (the “Defendant”) for damages in excess of $15,000.
2. Pursuant to the Complaint, the Bank alleges damages resulting from the default of certain loan documents (the “Loan Documents”) and seeks foreclosure of certain liens and interests in real property (the “Real Property”). The Loan Documents, as more fully described in the Complaint, include, but are not limited to, the following:
a. Promissory Note;
b. Business Loan Agreement;
c. Mortgage;
d. Assignment of Rents;
e. Commercial Guaranty, dated May 29, 2008;
f. Promissory Note;
g. Commercial Guaranty, dated September 25, 2009; and
h. Change in Terms Agreement.
3. This Action is pending in the Sixth Judicial Circuit in and for Pasco County, Florida.
4. The Real Property is located in Pasco County, Florida, and is more fully described as:
The West 1/2 of the East 1/2 of Tract 138, Osceola Heights Unit Eight, according to the map or plat thereof as recorded in Plat Book 8, Page 121, Public Records of Pasco County, Florida.
5. The Defendant is required to file written defenses with the Clerk of the Court and to serve a copy within thirty (30) days after the first publication of this Notice on Stephenie Biernacki Anthony, Esq., Anthony & Partners, LLC, 201 N. Franklin Street, Suite 2800, Tampa, Florida 33602, attorney for the Plaintiff. on or before 1/4/16
