NOTICE IS HEREBY GIVEN pursuant to an Order or Summary Final Judgment of foreclosure dated October 22, 2015 , and entered in Case No. 582013CA0028840000NC of the Circuit Court in and for Sarasota County, Florida, wherein THE BANK OF NEW YORK MELLON, F/K/A THE BANK OF NEW YORK, AS TRUSTEE FOR BEAR STEARNS ASSET BACKED SECURITIES TRUST 2006-4, ASSET-BACKED CERTIFICATES, SERIES 2006-4 is Plaintiff and PETER J. NAPOLITANO A/K/A PETER NAPOLITANO; ALICE A. NAPOLITANO A/K/A ALICE NAPOLITANO; VENETIA COMMUNITY ASSOCIATION, INC.; VILLA PARADISO NEIGHBORHOOD ASSOCIATION, INC.; CASA DI AMICI CONDOMINIUM ASSOCIATION, INC.; UNKNOWN TENANT NO. 1; UNKNOWN TENANT NO. 2; and ALL UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER OR AGAINST A NAMED DEFENDANT TO THIS ACTION, OR HAVING OR CLAIMING TO HAVE ANY RIGHT, TITLE OR INTEREST IN THE PROPERTY HEREIN DESCRIBED, are Defendants, KAREN E. RUSHING, Clerk of the Circuit Court, will sell to the highest and best bidder for cash at www.sarasota.realforeclose.com,9:00 a.m. on the 19th day of February, 2016, the following described property as set forth in said Order or Final Judgment, to-wit:
UNIT M-15-C, PHASE III, CASA DI AMICI, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM, AS RECORDED IN OFFICIAL RECORDS INSTRUMENT #2003242857, AND RECORDED IN OFFICIAL RECORDS INSTRUMENT #2004067960 AND AS AMENDED IN OFFICIAL RECORDS INSTRUMENT #2004229649, AND AS PER PLAT THEREOF RECORDED IN CONDOMINIUM BOOK 37, PAGE 21, AS AMENDED, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
Pursuant to Florida Statute 45.031(2), this notice shall be published twice, once a week for two consecutive weeks, with the last publication being at least 5 days prior to the sale.
