Notice is hereby given pursuant to the final judgment entered in the above noted case, that Ken Burke, Pinellas County Clerk of Court, will sell the following property described as:
Renewal Note dated March 9, 2009 executed by ISRA Development, LLC, as borrower, in favor of EZ Loans, LLC, as lender, in the principal amount of $675,000.00
and
Purchase Money Mortgage granted to Providence Mortgage Corporation, as lender and mortgagee, by ISRA Development, LLC, as borrower and mortgagor, on or about October 13, 2006, and recorded on October 25, 2006 in Official Records Book 15441, at Page 2647, of the Public Records of Pinellas County, Florida. The mortgage described herein was later modified, amended and superseded by the terms of:
(i) Mortgage Modification and Future Advance dated November 20, 2008 entered into by EZ Loans, LLC, as lender and mortgagee, and ISRA Development, LLC, as borrower and mortgagor, and recorded in Official Records Book 16441, at Page 2696, of the Public Records of Pinellas County, Florida; and
(ii) Mortgage Modification and Notice of Future Advance dated March 9, 2009 entered into by EZ Loans, LLC, as lender and mortgagee, and ISRA Development, LLC, as borrower and mortgagor, and recorded in Official Records Book 16521, at Page 407, of the Public Records of Pinellas County, Florida
and
Continuing and Unconditional Guaranty Agreement executed by Arial Bergerman in favor of EZ Loans, LLC dated March 9, 2009
at public sale, to the highest and best bidder for cash in an online sale at www.pinellas.realforeclose.com, at 10:00 a.m. on March 17, 2015. The highest bidder shall immediately post with the Clerk, a deposit equal to 5% of the final bid. The deposit must be cash or cashier's check payable to the Clerk of the Circuit Court. Final payment must be made by 11:00 am EST on the next business day after the sale to the Clerk by cash or cashier's check.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
