NOTICE IS HEREBY GIVEN pursuant to a Summary Final Judgment of Foreclosure dated December 16, 2014, and entered in Case No. 41-2009-CA-011139 Div. B of the Circuit Court of the 12th Judicial Circuit, in and for MANATEE County, Florida, where in BAYVIEW LOAN SERVICING, LLC, is the Plaintiff and ELISABETH H. ARGUELLES, C. IVAN STOLTZFUS, UNKNOWN PARTIES IN POSSESSION #1 AS TO UNIT “A” N/K/A CHRIS BELCHER, UNKNOWN PARTIES IN POSSESSION #2 AS TO UNIT B N/K/A PEGGY SHONGO, UNKNOWN PARTIES IN POSSESSION #1 AS TO UNIT B N/K/A KIM SHONGO, are the Defendants, the Clerk of Court shall offer for sale to the highest bidder for cash on March 19, 2015, beginning at 11:00 A.M., at www.manatee.realforeclose.com, the following described property as set forth in said Summary Final Judgment lying and being situate in MANATEE County, Florida, to wit:
The Westerly 1/2 of Lot 6 and the following described portion of Lot 5, R.H. Johnson's Subdivision of Lot 4, Block “C” of Plat of That Part of the Town of Manatee, Florida, according to the plat thereof as recorded in Plat Book 1, Page 261, of the Public Records of Manatee County Florida; Begin at the Southeast corner of said Lot 5, thence North 5`44'16” West, along the Easterly line of Lot 5, 160.98 feet; thence South 81`01'56” West, 47.30 feet to a fence corner, thence South 9`39'01” East, along an occupied fence line a distance of 153.26 feet to the intersection of the Southerly line of Lot 5, as staked; thence North 87`03'17” East, along said Southerly line a distance of 36.06 feet to the Point of Beginning.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE. THE CLERK SHALL RECEIVE A SERVICE CHARGE OF UP TO $70 FOR SERVICES IN MAKING, RECORDING, AND CERTIFYING THE SALE AND TITLE THAT SHALL BE ASSESSED AS COSTS. THE COURT, IN ITS DISCRETION, MAY ENLARGE THE TIME OF THE SALE. NOTICE OF THE CHANGED TIME OF SALE SHALL BE PUBLISHED AS PROVIDED HEREIN.
