LEALANN RUSSELL COOLEY
DECEASED
The undersigned Petitioner alleges:
1) The petitioner has an interest in the above Estate as the surviving brother of the decedent and should be nominated as the Personal Representative of the above Estate. The remaining siblings of the decedents were estranged from the decedent at the time of his death and are estranged from the Petitioner. There is no Last Will and Testament for the decedent.
2) Decedent, DECEDENT, whose last known address was 3311 40th Street N. St. Petersburg, FL 33713, and if known, whose age was 46, and whose Social Security Number is SS# 526-47-2796, died on September 7, 2013, and the time of his death was domiciled in Pinellas County, Florida.
3) So far as it is known, the names of the beneficiaries of the Estate and of the decedent's surviving spouse, their addresses and relationship to the decedent, and the ages of any who are minors, are:
NAME & ADDRESS, RELATIONSHIP, AGE William R. Cooley 3207 S. Washington Amarillo, TX 79109, Brother, 49; Rhonda Cooley address unknown, sister, 51; Victoria Brooke Martin-Cooley 2580 39th Avenue N. St. Petersburg, FL 33713, daughter, 16; Karradine Baker Address unknown, sister, 54
4). The venue of this proceeding is in Pinellas County because decedent resided in this County at the time of his death.
5) WILLIAM R. COOLEY, whose address is 3207 S. Washington, Amarillo, TX 79109, and who is qualified under the laws of the State of Florida to serve as Personal Representative of the decedent's Estate is entitled to preference as Personal Representative because he is the surviving brother of the decedent and is the only surviving relative with exception of his minor daughter, Victoria Brooke Martin-Cooley that was in contact with the decedent at the time of his death.
6) Petitioners are unaware of any unrevoked will or codicil of decedent.
7) Petitioners are entitled to Summary Administration because:
To the best knowledge of the Petitioner, the value of the entire estate subject to administration in this State, less the value of property exempt from the claims of creditors, does not exceed $25,000.00.
8) The nature and approximate value of the assets in this Estate, known at the time of filing, are (20) Remington 30-30 bullets, 18 shotgun shells on black belt, Ithica Deerslayer 12 ga shotgun S#-371175448, black/black Charter Arms Bulldog 44SPL 5 shot revolver, Marlin 336 Rifle (30-30) S#-P1307, property valued at approximately $900.00.
9) All creditor's claims are barred.
10) The Estate is not indebted.
11) It is proposed that all assets of the decedent, including exempt property, be distributed to the following:
NAME/ADDRESS WILLIAM R. COOLEY 3207 S. Washington Amarillo, TX 79109 ASSET, SHARE OR AMOUNT all guns, belts and bullets
Petitioner requests that an Order of Summary Administration be entered directing distribution of the assets in the Estate in accordance with the schedule set forth in paragraph 11 of this Petition.
