PUBLIC MEETING NOTICE
OF THE CITY OF WINTER GARDEN CANVASSING BOARD
AND ELECTION AUDIT FOR THE MARCH 10, 2015
GENERAL MUNICIPAL ELECTION
The City of Winter Garden Canvassing Board will meet at the Orange County Supervisor of Elections office, 119 West Kaley Street, Orlando, Florida, after 4:00 p.m. on Tuesday, March 10, 2015, for the purpose of conducting the logic and accuracy test on the absentee ballot tabulating equipment; canvassing the election returns; certifying the results; and conducting an audit of the General Municipal Election for Commissioner District 4 of Winter Garden, Florida, held on March 10, 2015. Tabulation of accepted absentee ballots will not begin until after 7:00 p.m. on Tuesday, March 10, 2015.
In accordance with the Sunshine Law of Florida, this meeting is open to the public and pursuant to Section 101.68(2)(c)2, Florida State Statutes, if any elector or candidate believes that an absentee ballot is illegal due to a defect apparent on the voter's certificate, he or she may at any time before the ballot is removed from the envelope, file with the Canvassing Board a protest against the canvass of that ballot, specifying the ballot precinct, the ballot, and reason he or she believes the ballot to be illegal. A challenge based upon a defect in the voter's certificate may not be accepted after the ballot has been removed from the mailing envelope. Said ballots will be made available to the public for inspection at the Orange County Supervisor of Elections office, 119 West Kaley Street, Orlando, Florida from 8:00 a.m. to 9:00 a.m. prior to the Canvassing Board convening. Absentee ballots received after 12:00 noon Tuesday, March 10, 2015, will be made available to the public for inspection immediately prior to the board convening at 4:00 p.m.
If a recount is necessary, the board will reconvene at the Orange County Supervisor of Elections office, 119 West Kaley Street, Orlando, Florida, at 12:00 noon, Thursday, March 12, 2015. If the election has been certified, the board will reconvene at the same location at 3:00 p.m., Thursday, March 12, 2015, to audit the precincts in accordance with Chapter 101.591, Florida Statutes and Rule 1S-5.026, F.A.C. If necessary, the board will reconvene on Thursday, March 12, 2015, at 5:00 p.m. to canvass any provisional ballots not otherwise previously processed, certify the election results, and audit Precinct 4103. Any ballots cast during the early voting period, in Precinct 4103 for auditing by the Canvassing Board will be segregated from the other early voting ballots cast. The process of separating these early voting ballots will be open to the public for viewing and will commence immediately. The finalized meeting schedule will be posted on the City's website and at City Hall.
Note: ยง286.0105, Florida Statutes, states that if a person decides to appeal any decision by a board, agency, or commission with respect to any matter considered at a meeting or hearing, he or she will need a record of the proceedings and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
