FOR APPOINTMENT OF TEMPORARY AND PERMANENT GUARDIAN OF THE PERSON OVER MINOR

On June 1, 2015, a hearing was held to determine whether emergency temporary co-guardians should be appointed for ChaCha Rachel Johnson (date of birth November 20, 2013, age 1 (the “Child”). Complete copies of the petitions, motions and orders from that proceeding will be made available immediately upon written request to co-guardians counsel, Jack M. Freedman, Freedman Law, 11650 Lantern Road, Suite 217, Fishers, Indiana 46038 (317-576- 8440) or upon written request to the Clerk of the Hamilton County Superior Court, One Courthouse Square, Noblesville, Indiana 46060.
On the 29th day of July, 2015, at 9:30 a.m. in the Hamilton County Superior Court 1, One Hamilton County Square, Noblesville, Indiana 46060, a hearing will be held to determine whether a permanent guardian should be appointed for ChaCha Rachel Johnson (the “Child”). The purpose of this proceeding is to protect the Child.
At the final hearing, the Court will determine whether the Child is an incapacitated person or minor under Indiana law. If the Court finds that the Child is an incapacitated person or minor, the Court will then consider whether Carson D. Johnson and Ena Lima-Johnson should be appointed as permanent co-guardians of the Child's person. The Court may, in its discretion, appoint some other qualified person to serve as guardian. The Court may also determine whether a protective order should be entered on behalf the Child. The Child may attend the hearing and may be represented by an attorney. The petition may be heard and determined in the absence of the Child if the Court determines that the Child's presence is not required. If the Child attends the hearing, opposes the petition, and is not represented by an attorney, the Court may appoint an attorney to represent the Child. The Court may, where required, appoint a guardian ad litem to represent the Child at the hearing.
The Court may on its own motion or on request of any interested person, postpone the hearing to another date and time.
