NOTICE OF RECORDING
NOTICE OF PRESERVATION OF
COVENANTS, CONDITIONS AND RESTRICTIONS
Pursuant to Chapter 712, Florida Statutes (“MRTA”), Waterberry A Private Land Reserve Homeowners Association, Inc., a Florida not-for-profit corporation (the “Association”), recorded a Notice of Preservation of Covenants, Conditions and Restrictions (“Notice”) to preserve and protect the Declarations of Covenants, Conditions and Restrictions identified herein from extinguishment by operation of MRTA.
1. The Notice was recorded in Pinellas County Official Records Book 18811, Pages 2695 - 2744, by the Association, located in Tarpon Springs, Florida, the Articles of Incorporation of which were originally filed in the office of the Secretary of State on December 22, 1986, as document number N18403, the Association having been organized for the purpose of operating and administering the subdivision known as Waterberry, pursuant to the recorded covenants pertaining thereto which were filed by the instruments of record, as same are recorded in:
Official Records Book 6327, Pages 691 - 718 of the Public Records of Pinellas County, Florida, as amended, and by reference, incorporated therein.
2. The Association sent a Statement of Marketable Title Action in the form set forth in Section 712.06(1)(b), Florida Statutes, to all affected members of the Association, and duly approved preservation of such Covenants, Conditions and Restrictions as required by Section 712.05(1), Florida Statutes. Affidavits relating to said actions were attached as a Composite Exhibit “A” to the recorded Notice referenced above.
3. The lands affected by this Notice are depicted and legally described as Waterberry A Private Land Reserve, according to plat thereof recorded in Plat Book 95, Page 5, of the Public Records of Pinellas County, Florida.
