NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated March 4, 2015, entered in Case No. 13-CA-053808 of the Circuit Court of the Twentieth Judicial Circuit, in and for Lee County, Florida, wherein HSBC Bank USA, National Association, as Trustee for the Certificateholders of Merrill Lynch Mortgage Investors, Inc., Mortgage Pass-Through Certificates, MLMI Series 2006-A4 is the Plaintiff and Banyan Tree Condominium Association of Fort Myers Inc.; Any and all Unknown Parties claiming by, through, under, and against the herein named individual Defendants who are not known to be dead or alive, whether said unknown parties may claim an interest as Spouses, Heirs, Devisees, Grantees or other Claimants; Unknown Tenant(s) in Possession are the Defendants, that I will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com, beginning at 9:00 AM on the April 8, 2015, the following described property as set forth in said Final Judgment, to wit:
UNIT 202, THE BANYAN TREE OF FORT MYERS, A CONDOMINIUM ACCORDING TO THE CONDOMINIUM DECLARATION AS RECORDED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF LEE COUNTY, FLORIDA, IN OFFICIAL RECORDS BOOK 1772, PAGE 4113, AND AS AMENDED, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS AND ALL APPURTENANTS THEREUNTO APPERTAINING AND SPECIFIED IN SAID CONDOMINIUM DECLARATION.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
