The Notice of Preservation of the First Amendment and Restatement of Declaration of Covenants, Conditions and Restrictions for Glen Lakes was recorded at Official Records Book 18701, Page 2235 in the Public Records of Pinellas County, Florida by Shawn G. Brown, Lang & Brown, P.A., P.O. Box 7990, St. Petersburg, Florida 33734, (727) 522-9800.
THIS NOTICE AND CLAIM PURSUANT TO SECTIONS 712.05 AND 712.06, FLORIDA STATUTES is made this 4th day of March, 2015 by The Enclave at St. Petersburg Condominium Association, Inc., a Florida corporation note for profit.
WHEREAS, The Enclave at St. Petersburg is a condominium in Pinellas County, Florida, appearing in Official Records Book 14824, Page 593, of the public records of Pinellas County, Florida with an unrecorded Condominium Plat Book; and Windjammer is a condominium in Pinellas County, Florida appearing in Condominium Plat Book 111, Page 1, of the Public Records of Pinellas County, Florida with a Declaration of Condominium recorded in Official Records Book 7935, Page 465 of the Public Records of Pinellas County, Florida; and Glen Lake Estates if a platted subdivision in Pinellas County, Florida appearing in Plat Book 97, Page 58 of the Public Records of Pinellas County, Florida with a Declaration of Covenants recorded in Official Records Book 6380, Page 1941 of the Public Records of Pinellas County, Florida; and
WHEREAS, First Baptist Church of St. Petersburg, Inc. is the record owner of Lot 2, Glen Lakes in accordance with the deed recorded in Official Records Book 6000, Page 396 and further described in Plat Book 89, Page 72, both of the Public Records of Pinellas County Florida; and
WHEREAS, PBH Prospect Gateway, LLC is the record owner of Tract 1 of Glen Lakes Broderick Addition in accordance with the deed recorded in Official Records Book 18002, Page 2341 and further described in Plat Book 92, Page 77, both of the Public Records of Pinellas County Florida; and
WHEREAS, Otterside Apartments Realty Trust is the record owner of Lot 1, Block 1 of Northgate Shops Subdivision in accordance with the deed recorded in Official Records Book 15176, Page 2001 and further described in Plat Book 113, Page 51, both of the Public Records of Pinellas County Florida; and
WHEREAS, CW33, LLC is the record owner of Lot 2, Block 1 of Northgate Shops Subdivision in accordance with the deed recorded in Official Records Book 17740, Page 1027 and further described in Plat Book 113, Page 51, both of the Public Records of Pinellas County Florida; and
WHEREAS, The Enclave at St. Petersburg Condominium Association, Inc., a Florida corporation not for profit, desires to preserve the First Amendment and Restatement of Declaration of Covenants, Conditions and Restrictions for Glen Lakes as recorded in Official Records Book 5961, Page 1351, of the public records of Pinellas County, Florida, with respect to the lands and real property described herein above and herein below pursuant to Sections 712.05 and 712.06, Florida Statutes.
NOW THEREFORE, The Enclave at St. Petersburg Condominium Association, Inc., a Florida corporation not for profit, declares and provides notice that every portion of the lands and real property described herein above and herein below shall remain subject to the Declaration of Covenants, Conditions and Restrictions for Glen Lakes, as recorded in Official Records Book 5961, Page 1351, of the public records of Pinellas County, Florida, pursuant to the provisions of Sections 712.05 and 712.06, Florida Statutes as hereinafter set forth below by the recording of this instrument and compliance with the provisions of Sections 712.05 and 712.06, Florida Statutes.
1. General Provisions. The foregoing Recitals are true and correct and are incorporated into and form part of this Notice and Claim pursuant to Section 712.05 and 712.06, Florida Statutes.
2. Names and Addresses. The name of the homeowners' association desiring to preserve the covenants and/or restrictions described herein above and herein below is The Enclave at St. Petersburg Condominium Association, a Florida corporation not for profit c/o Lang & Brown, P.A., 5001 4th Street North, Suite A, St. Petersburg, FL 33703. In addition, the names and post office addresses of the owners of all lands and real property affected by this notice and claim is attached to this instrument as “Exhibit A” to satisfy the requirements of Section 712.06(1)(b), Florida Statutes.
3. Affidavit. An affidavit executed by an appropriate member of the Board of Directors for The Enclave at St. Petersburg Condominium Association, Inc., affirming that the Board of Directors of The Enclave at St. Petersburg Condominium Association, Inc. caused as Statement of Marketable Title Action substantially in the form set out in Section 712.06(1)(b), Florida Statutes, to be mailed or hand-delivered to the parcel owners or their representative association that are subject to the Declaration of Covenants, Conditions and Restrictions for Glen Lakes is attached to this instrument as “Exhibit B” and is incorporated herein by reference to satisfy the requirements of Section 712.06(1)(b), Florida Statutes.
4. Legal Description. A full and complete description of the lands and real property affected by this notice and claim is attached hereto as “Exhibit C” and is incorporated herein by reference.
