HOME EQUITY LOAN TRUST, SERIES 2006-FM1, ASSET BACKED PASS-THROUGH CERTIFICATES is the Plaintiff, and DAVID A. FUTCH A/K/A DAVID ALVIN FUTCH A/K/A DAVID FUTCH; UNKNOWN SPOUSE OF DAVID FUTCH A/K/A DAVID ALVIN FUTCH A/K/A DAVID FUTCH; CAPITAL ONE BANK (USA ) NA; UNKNOWN TENANT #1, UNKNOWN TENANT #2, UNKNOWN TENANT #3, UNKNOWN TENANT #4, THE NAMES BEING FICTITIOUS TO ACCOUNT FOR PARTIES IS POSSESSION; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.

COMMENCE AT THE SOUTHWEST CORNER OF THE WEST 1/2 OF THE SE 1/4 OF THE SE 1/4 OF SECTION 13, TOWNSHIP 28 SOUTH, RANGE 22 EAST, LYING AND BEING IN HILLSBOROUGH COUNTY, FLORIDA, RUN THENCE NORTH A DISTANCE OF 33 FEET TO THE NORTH EDGE OF THE EXISTING ROAD RIGHT OF WAY, RUN THENCE EAST 664.2 FEET FOR A POINT OF BEGINNING, RUN THENCE NORTH 436 FEET, THENCE WEST 100 FEET, THENCE SOUTH 436 FEAT, THENCE EAST 100 FEET TO POINT OF BEGINNING.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
