Final Judgment was awarded on April 29, 2015 in Civil Case No. 2013-CA-000905, of the Circuit Court of the TWENTIETH Judicial Circuit in and for Collier County, Florida, wherein, WELLS FARGO BANK, N.A. is the Plaintiff, and GARY DEROSA, AS TRUSTEE OF THE OLGA DEROSA TESTAMENTARY TRUST DATED NOVEMBER 15, 1995; MAUREEN DEROSA SILVER, AS TRUSTEE OF THE OLGA DEROSA TESTAMENTARY DATED NOVEMBER 15, 1995; UNKNOWN SPOUSE OF GEORGE DEROSA NIK/A ROSE DEROSA; UNKNOWN SPOUSE OF GARY DEROSA; UNKNOWN SPOUSE OF MAUREEN DEROSA SILVER N/K/A DAVID SILVER; THE CHALET OF SAN MARCO CONDOMINIUM ASSOCIATION, INC., A FLORIDA CORPORATION; THE UNKNOWN BENEFICIARIES OF THE OLGA DEROSA TESTAMENTARY TRUST DATED NOVEMBER 15, 1995; THE UNKNOWN SUCCESSOR TRUSTEE OF THE OLGA DEROSA TESTAMENTARY TRUST DATED NOVEMBER 15, 1995; GARY DEROSA, INDIVIDUALLY; MAUREEN DEROSA SILVER, INDIVIDUALLY; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS are Defendants.
The clerk of the court, Dwight E. Brock will sell to the highest bidder for cash at the 3rd Floor, Lobby, Collier County Courthouse Annex, located at 3315 Tamiami Trail East, Naples, FL 34112 on June 15, 2015, at 11:00 AM, the following described real property as set forth in said Final Summary Judgment, to wit:
UNIT NO. 801, OF THE CHALET OF SAN MARCO, A CONDOMINIUM AS RECORDED IN CONDOMINIUM PLAT BOOK 18, PAGE 11, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, TOGETHER WITH THE PRO-RATA INTEREST IN THE COMMON ELEMENTS AND COMMON PROPERTY OF THE CONDOMINIUM AND LIMITED COMMON ELEMENTS APPURTENANT THERETO, MORE PARTICULARLY DELINEATED AND IDENTIFIED IN THE DECLARATION OF CONDOMINIUM FOR THE CHALET OF SAN MARCO, A CONDOMINIUM RECORDED IN O.R. BOOK 911, PAGES 371 THROUGH 464, AS AMENDED, AND SURVEYOR'S CERTIFICATE AS RECORDED IN O.R. BOOK 919, PAGES 731 THROUGH 732, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
