NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated August 28, 2015, entered in Case No. 14-CA-051355 of the Circuit Court of the Twentieth Judicial Circuit, in and for Lee County, Florida, wherein The Bank of New York Mellon fka The Bank of New York as Trustee for the Certificateholders of the CWABS Inc., Asset-Backed Certificates, Series 2005-17 is the Plaintiff and Andrew Collins; Madonlin Bay Villas Condominium Association, Inc.; The Unknown Spouse, Heirs, Devisees, Grantees, Assignees, Lienors, Creditors, Trustees, and all other parties claiming interest by, through, under or against the Estate of Jan Hurley-Tompkins a/k/a Janice L. Hurley Tompkins, Deceased are the Defendants, that I will sell to the highest and best bidder for cash by electronic sale at www.lee.realforeclose.com, beginning at 9:00 AM on the September 30, 2015, the following described property as set forth in said Final Judgment, to wit:
UNIT NO. 102, BUILDING D, OF MANDOLIN BAY VILLAS, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN O.R. BOOK 4486, PAGE 4344, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN AND TO THE COMMON ELEMENTS AS DESCRIBED IN SAID DECLARATION OF CONDOMINIUM AND INCLUDING BUT NOT LIMITED TO THE USE OF TWO AUTOMOBILE PARKING SPACES NUMBERED D102 BEING LIMITED COMMON ELEMENTS FOR SAID UNIT.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
